The following terms and conditions are based on the Japanese rental agreement. By renting a vehicle with us, you agree to these terms.
Chapter 1: General Provisions
Article 1: Application of Terms
- Freedom Car Rental provides rental vehicles (“rental cars”) to renters under the terms of this agreement. Matters not specified here will be governed by applicable laws or general customs.
- Special provisions may be arranged as long as they do not violate laws or general practices, and such provisions will take precedence over these terms.
Chapter 2: Reservations
Article 2: Reservation Application
- Renters can make reservations by specifying the vehicle type, rental period, pick-up and return locations, and any additional requirements (“rental conditions”).
- Reservations are subject to availability, and a deposit may be required.
Article 3: Changes to Reservations
Changes to rental conditions require prior approval from Freedom Car Rental.
Article 4: Cancellation of Reservations
- Renters may cancel reservations with prior notice; a cancellation fee may apply.
- Failure to pick up the vehicle within one hour of the scheduled time will result in automatic cancellation.
- Freedom Car Rental reserves the right to cancel reservations due to unavoidable circumstances (e.g., natural disasters) and will refund any deposits.
Chapter 3: Rental Agreement
Article 5: Formation of the Agreement
- The agreement is formed when the renter signs the contract, pays the required fees, and the vehicle is delivered.
- Renters must present a valid driver’s license, passport (if applicable), and other required documents.
Article 6: Rental Fees
Rental fees include basic charges, insurance, and any additional services requested by the renter.
Article 7: Denial of Rental
Freedom Car Rental may refuse rental in cases such as:
- Failure to provide required documentation.
- Evidence of intoxication or drug influence.
- Previous violations of rental agreements.
Chapter 4: Vehicle Use
Article 8: Responsibilities of Renters
- Renters must operate the vehicle with due care and adhere to all traffic laws.
- Daily maintenance checks are the renter’s responsibility.
Article 9: Prohibited Uses
Renters are prohibited from:
- Subleasing or transferring the vehicle to others.
- Altering or modifying the vehicle.
- Using the vehicle for illegal activities, races, or towing.
Article 10: Accidents
- In the event of an accident, renters must:
- Stop immediately and contact both Freedom Car Rental and local authorities.
- Submit all necessary documents to the insurance company.
- Renters are liable for the insurance excess and any non-covered damages.
Chapter 5: Vehicle Return
Article 11: Return Obligations
- Vehicles must be returned on time and in the same condition as at pickup (normal wear and tear excepted).
- Late returns will incur additional charges.
Article 12: Inspection Upon Return
Freedom Car Rental will inspect the vehicle for damage, missing items, or excessive wear.
Chapter 6: Insurance and Liability
Article 13: Insurance Coverage
- Insurance includes:
- Unlimited liability for third-party injuries.
- Property damage up to [specified amount].
- Vehicle damage up to the market value.
- Insurance does not cover:
- Accidents not reported to authorities or Freedom Car Rental.
- Damages caused by prohibited uses.
Article 14: Compensation for Downtime
Renters may be charged a Non-Operation Charge (NOC) if the vehicle becomes inoperable due to negligence.
Chapter 7: Termination of Agreement
Article 15: Termination Due to Accident
Freedom Car Rental reserves the right to terminate the rental agreement immediately following any accident. The renter remains liable for the insurance excess regardless of fault.
Chapter 8: Disputes and Governing Law
Article 16: Governing Law
This agreement is governed by the laws of Japan.
Article 17: Jurisdiction
Disputes will be resolved in the courts located within the jurisdiction of Freedom Car Rental’s headquarters.
